TERMS & CONDITIONS

This agreement represents the complete agreement and understanding between MAGSNET and the account holder (hereinafter called Client) and supersedes any other written or oral agreement. Upon notice published online via MAGSNET services, MAGSNET may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered.If you do not agree to these terms and conditions, please notify our Billing Department so we can initiate a closure of your account. USE OF YOUR ACCOUNT shall constitute your approval. Services provided to the Client by MAGSNET may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any Government regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material. MAGSNET reserves the right to remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement.The Client agrees to defend, hold harmless and expeditiously indemnify MAGSNET from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in this Policy and resulting from the Client's use of the service.

MAGSNET accounts cannot be transferred or used by anyone other than the subscriber. The Client may not sell, lease, rent or assign the connection or parts of the connection to any party not named in this Policy.

The Client is responsible for all activities originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password, and distributing it only to authorized personnel only.

The Client may allow ftp access to its server to Authorized Personnel only.

Use of MAGSNET's hosting services requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of MAGSNET to provide this knowledge or support outside matter specific to MAGSNET's hosting servers.MAGSNET reserves the right to cancel service for any reason without prior notice. In case of cancellation, unused fees may be returned to the subscriber. Fees for setup and the first month's service are not refundable.

The Client can cancel the hosting account after 1 month’s (30 days) prior to notice to MAGSNET. The account shall be closed after the completion of the contract period of the plan, and the Client shall be subsequently billed for the used service. MAGSNET reserves the right to cancel service due to non-payment of payable dues. In case of cancellation, the Client is still obliged the pay the payable dues for the service it has already used. Re-starting the service after payment of the dues is strictly upon MAGSNET’s discretion. MAGSNET reserves the right to take legal action against the Client who does not pay the dues or refuses payment altogether.Setup fees are non-refundable.

Client agrees not to transmit, promote, or otherwise make available any software, product or service that is either illegal or designed to violate this Agreement. Such software, products or services include, but are not limited to, programs designed to send unsolicited advertisements (i.e. "spamware") and services which send unsolicited advertisements. MAGSNET requires that its agreements be made with a person who is qualified to contract. As such, subscriber must be over the age of eighteen (18) years. Otherwise, a parent or guardian must accept this agreement and enclose the proper payment. MAGSNET cannot accept payments from persons who are not at least eighteen (18) years of age, nor can we accept agreements from persons who are not at least eighteen (18) years of age. Client shall ensure that it uses only the space, bandwidth, and other account privileges allocated to him, and does not try to breach, hack, or break into accounts of other clients of MAGSNET.

Client should not try to enhance the services provided to him using unlawful means and/or without bringing it to MAGSNET’s notice.

Use of other organizations' networks or computing resources is subject to their respective permission and usage policies. For all new domains, there is a yearly non-refundable registration fee. MAGSNET will automatically pay this fee as well as all annual non-refundable renewal fees on your behalf while your MAGSNET account is active and current. These fees will appear on your billing statement unless prior arrangements are made with our Client service department.

In case Client does not pay its dues or refuses to pay for the domain name it registered, MAGSNET has the right to sell out the domain name to any company/individual who agrees to buy the domain name at the price demanded by MAGSNET. Use of MAGSNET's hosting services could involve listing subscriber's participation in relevant directories, and subscriber expressly grants permission for such listings.

Use of MAGSNET’s hosting service automatically enlists the Client to MAGSNET’s newsletter, which it issues time after time. MAGSNET can forward promotional schemes, special offers to its Clients using the newsletter.

Any party seeking to report any other potential violations of this Agreement may contact MAGSNET via email at info@magsnet.net Transferring your domain to another provider does not constitute canceling your MAGSNET account. You must notify MAGSNET to formally cancel your account with MAGSNET to avoid further charges. On occasion, MAGSNET may have a need to communicate with its Clients through email issues related to billing, as well as changes, additions and modifications to the network. It is the responsibility of the Client to check email sent to the primary login email address on the account.

It is the responsibility of the Client to contact MAGSNET of any changes to their account, such as phone number, address, credit card information, etc. Clients will be required to provide verification for security purposes authorizing them to make any changes to that account.
